    Kiambu court frees legislator on KSh100,000 cash bail as legal challenge against his arrest heads for September hearing.

    KIAMBU, Kenya – The High Court in Kiambu has ordered the immediate release of Mukurweini MP John Kaguchia after granting him a KSh100,000 cash bail pending the hearing of his application challenging his arrest.

    In a ruling delivered on Monday, Lady Justice Njoki Mwangi directed that the legislator be released from police custody immediately upon depositing the cash bail, granting him temporary relief as he pursues legal action against the Inspector General of Police, the Director of Public Prosecutions (DPP) and another respondent.

    The court certified Kaguchia’s application as urgent and allowed several prayers contained in his Notice of Motion filed on Monday.

    Justice Mwangi further directed the MP to serve the application on all respondents without delay. The respondents have been granted 14 days to file and serve their responses, while Kaguchia was given leave to file a supplementary affidavit within 14 days after receiving the responses, if necessary.

    The matter has been scheduled for a virtual hearing on September 16, 2026, when the court will hear the substantive issues raised in the application.

    The case, filed as Criminal Miscellaneous Application No. HCCRMISCAPPL/E070/2026 before the Kiambu High Court, challenges the legality of Kaguchia’s arrest and subsequent detention.

    Kaguchia’s arrest followed remarks that sparked political debate and attracted criticism from opposition leaders, who described the move as an attack on freedom of expression. Government authorities, however, have maintained that the investigations and any legal action are being conducted in accordance with the law.

    The September hearing is expected to determine the merits of the legislator’s application as the legal challenge against his arrest proceeds before the High Court.
